This waiver is made in favor of JapanWithEase, its owners, employees, agents, coaches, and partners (hereinafter: "Service Provider"). The person making this declaration (hereinafter: "Participant") acts on their own behalf, or – in the case of a minor – on behalf of the child under their care.
This waiver applies to all sports activities organized by the Service Provider, including – but not limited to – individual and group training sessions, sports lessons, use of sports facilities, and all related events and forms of physical activity. For example, but not limited to: hiking, yoga, martial arts or self-defense training, team sports, recreational training, and indoor or outdoor physical exercises.
The Participant expressly acknowledges and accepts that sports activities involve physical exertion and may carry the following risks:
Muscle strains, sprains, fractures, and other physical injuries
Cardiovascular problems, fatigue
Accidents resulting from the actions of other participants
Equipment malfunction or damage
Physical hazards of the sports facility or environment (e.g., slipping, rackets, balls, etc.)
Weather-related hazards (e.g., heat, rain, risk of slipping)
Loss, damage, or disappearance of personal belongings
The Participant declares that they have fully understood the above and other risks naturally associated with the activity and voluntarily assume them.
The Participant – to the extent permitted by applicable law – waives all claims for damages that may arise against the Service Provider due to accidents, injuries, or property damage sustained during the aforementioned activities, except where caused by the Service Provider's intentional act or gross negligence.
The Participant declares that they are currently medically fit to perform the designated activities and are not aware of any health condition that would make participation dangerous.
The Participant accepts that:
It is their own responsibility to seek medical advice before participation if necessary.
The Service Provider does not conduct medical fitness examinations.
They are obliged to share all relevant health information with the Service Provider.
They are obliged to immediately report any illness or injury occurring during the activity.
The Participant acknowledges that the Service Provider is not responsible for the loss, damage, or disappearance of personal belongings occurring within the facility.
The Participant undertakes to comply with the safety instructions set by the Service Provider, the facility rules, and the guidance of coaches or organizers. Violation of these rules may lead to the Participant's exclusion and may limit the Service Provider's liability.
The Participant declares that they are participating in the activities voluntarily, have understood and accepted the terms, and consciously assume the risks.
This declaration is governed by Japanese law. (Note: If the Participant lives in another country or the service is cross-border, this clause may require legal advice.)
This declaration comes into effect upon the Participant's acceptance and applies exclusively to the designated activities. Should the Service Provider significantly modify the terms, acceptance of a new declaration will be required.
The Participant acknowledges that the Service Provider may take photographs and video recordings during activities organized by them, in which the Participant may be recognizably featured. The Service Provider may use these recordings exclusively for the following purposes:
Documenting the event
Promotional and marketing purposes (e.g., on the website, social media platforms, printed materials)
Archiving and internal use
During the use of recordings, the Service Provider shall respect the Participant's human dignity and rights related to their image.
By accepting this declaration, the Participant consents to the use of recordings made of them in the manner described above, unless they notify in writing before or during the activity that they do not consent, or request that no recognizable recording be made of them, or that recordings made of them not be used publicly. The Service Provider strives to give fair consideration to such requests.
If any part of this declaration is found to be invalid, it shall not affect the validity of the remaining parts of the document.
Acceptance of this declaration may occur:
During online registration, by checking a box confirming acknowledgment of the terms.
Or on paper, by signing before the activity begins.
The Participant has the opportunity to read this declaration in advance and ask questions.
